General Terms and Conditions (GTC)

1. Applicability and Scope

The following General Terms and Conditions (hereinafter �GTC�) apply to all business relationships between Deep Dive Institute for Body and Energy Work, Dr. Chantal Sara Schlatter (hereinafter referred to as �DDIKE�, �us�, or �we�) and customers (hereinafter referred to as �Customer� or �you�) for services (hereinafter referred to as �Service(s)�) provided by us.

Individual agreements concluded with the customer take precedence over these GTC. Opposing terms and conditions from the customer will not be recognized. The following provisions on services apply analogously to the sale of goods in our business.

DDIKE reserves the right to change these GTC at any time. All changes become effective with the publication of the new GTC on the website. The relevant date for the applicability of the valid GTC is the date of the binding appointment for the provision of the service.

Please read these GTC carefully before booking an appointment with us. By making a binding appointment, you agree to the following terms and conditions as well as to our privacy policy.

2. Offer and Prices

Our offer and prices correspond to those listed on the website and in-store. All prices are stated in CHF (Swiss Francs) and, unless otherwise noted, include statutory VAT.

DDIKE reserves the right to change its offers and prices at any time. All offers are subject to change and do not constitute binding offers.

DDIKE cannot guarantee that the listed services will be available at the time of service provision. Therefore, all information regarding the services is provided without guarantee and may change at any time without notice.

 

3. Payment Options

The following payment options are generally available for our services:

-       Cash, Twint, Mastercard, credit card, Paypal

By choosing the payment method, the customer authorizes payment either by entering credit card data or the access data for a payment service provider. The customer authorizes DDIKE to collect payments accordingly. In the case of chargebacks, DDIKE is entitled to reimbursement of associated costs and bank processing fees.

DDIKE reserves the right to change the available payment options at any time.

 

4. Appointment Booking and Conclusion of Contract

Appointments can be booked via our online reservation system, by telephone (including WhatsApp, SMS, etc.), or by email. The contract for provision of service is established when we confirm your appointment by email or phone. DDIKE reserves the right to cancel or reschedule an appointment free of charge and without compensation due to unforeseen circumstances (e.g., staff illness).

 

5. No-Show for Appointments

If the customer does not attend the agreed appointment for any reason, it must be cancelled at least 24 hours before the start of service provision, either by phone or email. A delay of 15 minutes also counts as a no-show. Otherwise, DDIKE reserves the right to invoice the booked service in full, unless the customer can provide a doctor�s certificate showing they were unable either to attend or to cancel in time. ?

6. Liability

DDIKE excludes all liability, regardless of legal grounds, as well as claims for damages against DDIKE and any assistants and agents. In particular, DDIKE is not liable for indirect damages and consequential harm, loss of profit, or any other personal, material, or pure financial damages to the customer. Statutory liability for gross negligence or intent remains reserved.

Events beyond our control

In the event of circumstances beyond our control (so-called force majeure), we accept no liability or responsibility for non-performance or delayed performance of any obligations under these GTC or contracts based on them. Such circumstances include, for example, strikes, fire, explosions, storms, floods, earthquakes, epidemics, or pandemics. If such an event affects the fulfillment of our contractual obligations, we will inform you as soon as possible.

7. Data Protection

DDIKE collects and processes personal data only in accordance with legal requirements, especially the applicable data protection laws. Further information on the processing of your personal data, your rights, and related issues can be found in our privacy policy here, which is an integral part of these GTC.

8. Copyright

The information and content published on the website are protected by copyright and are the property of DDIKE or the respective rights holder. Reproduction, editing, distribution, or any other form of use requires the prior written consent of the respective rights holder. DDIKE and the relevant copyright holder expressly reserve all rights in this regard.

9. Severability Clause

If any provision of these GTC should be or become illegal, invalid, or unenforceable for any reason, this does not affect the validity of the remaining provisions. Unless otherwise agreed, the invalid provision is replaced by one that best fulfills the economic purpose and the intentions of the parties at the time of contract conclusion. The same applies to any gaps in these GTC.

10. Applicable Law and Jurisdiction

These GTC, contracts based on them, and any disputes are subject exclusively to Swiss substantive law, excluding the conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction for natural persons is either the seat of DDIKE or the customer�s domicile. For legal entities, the exclusive place of jurisdiction is the seat of DDIKE.

 

11. Changes

These GTC may be amended from time to time and without prior notice. Unless otherwise stated, all amendments take effect when published on the website.
